When these Terms use “MukodesignUK”, “we”, “us” or “our”, they refer to DM AMBALAJ LTD trading as MukodesignUK.
These Terms govern your use of our website and purchases made through our online store. Our Shipping Policy, Returns, Cancellations and Refunds Policy and Privacy Policy also apply where relevant and form part of these Terms.
These Terms are intended primarily for customers purchasing as consumers. If you wish to purchase wholly or mainly for business purposes, please contact us before placing your order.
2. USING OUR WEBSITE
You may use our website only for lawful purposes.
You must not misuse the website, attempt to gain unauthorised access to it, introduce malicious code, interfere with its operation, obtain information through unauthorised automated methods or use it in a way that infringes another person’s rights.
You are responsible for ensuring that the information you provide to us, including your contact, billing and delivery information, is accurate and complete.
If you are under 18, you may use our store only with the involvement and permission of a parent or legal guardian.
3. PRODUCTS AND PRODUCT INFORMATION
We take reasonable care to ensure that product descriptions, photographs, dimensions, specifications and prices are accurate.
Colours and appearance may vary slightly depending on screen settings, lighting and normal manufacturing variations. This does not affect your legal right to receive goods that are as described, of satisfactory quality and fit for any particular purpose made known to us.
Product availability may change. Displaying a product on our website does not guarantee that it will remain available.
We may make reasonable changes to a product where required by law or where the change does not materially affect its main characteristics or quality.
4. ORDERS AND CONTRACT FORMATION
When you submit an order, you are making an offer to purchase the products in that order.
An automated order acknowledgement confirms that we have received your order. It does not by itself mean that we have accepted the order.
The contract between you and DM AMBALAJ LTD is formed when we send you a dispatch confirmation, unless we expressly confirm acceptance at an earlier time.
We may be unable to accept an order because:
• the product is unavailable;
• payment cannot be authorised;
• we cannot deliver to the address supplied;
• we reasonably suspect fraud or unauthorised activity;
• an order exceeds a reasonable purchase limit; or
• there is an obvious error in the product description or price that you could reasonably have recognised.
If we cannot accept an order, we will inform you and refund any payment already taken for that order.
Please check your order carefully before submitting it. If you notice an error, contact us as soon as possible at mukadder@rmpacks.com. We cannot guarantee that changes can be made after dispatch.
5. PRICES AND PAYMENT
Prices are shown in pounds sterling (GBP).
The total amount payable, including any applicable taxes and delivery charges, will be displayed before you submit your order.
Standard UK delivery is currently free, as explained in our Shipping Policy.
You must use a payment method that you are authorised to use. Payments may be processed by Shopify and other authorised payment providers.
We take reasonable care to ensure that prices are correct. If an obvious pricing error is discovered before acceptance, we may contact you for instructions or cancel the affected order and refund any payment taken.
Price changes will not affect an order that we have already accepted, except where required by law.
6. SHIPPING, DELIVERY AND RISK
We currently deliver only to addresses within the United Kingdom.
Delivery methods, processing times and estimated delivery times are described in our Shipping Policy.
Delivery estimates are not guaranteed dates unless we expressly agree a specific delivery deadline with you.
Unless a different delivery period has been agreed, goods will be delivered without undue delay and no later than 30 days after the contract is made.
We remain responsible for the goods until they are physically delivered to you or to a person identified by you to receive them.
If you independently arrange a carrier that was not offered by us, responsibility for the goods may pass to you when the goods are delivered to that carrier, as permitted by law.
If delivery is delayed or an order appears to be missing, please contact us at mukadder@rmpacks.com. Nothing in these Terms limits your legal rights relating to late or failed delivery.
7. CANCELLATIONS, RETURNS AND REFUNDS
Your rights to cancel an online order, return goods and receive a refund are explained in our Returns, Cancellations and Refunds Policy.
For most standard goods purchased online, consumers have a legal right to cancel without giving a reason. The applicable time limits, return procedure, return costs and refund process are set out in that policy.
Nothing in these Terms or our other policies restricts any consumer right that cannot lawfully be excluded.
8. FAULTY, DAMAGED OR MISDESCRIBED GOODS
We are under a legal duty to supply goods that are:
• of satisfactory quality;
• fit for their intended purpose; and
• as described.
If goods are faulty, damaged in transit, incorrect or not as described, please contact us at mukadder@rmpacks.com with your order number and details of the problem.
Depending on the circumstances, your legal remedies may include rejection and refund, repair, replacement or a price reduction.
Nothing in these Terms limits your rights under the Consumer Rights Act 2015 or other applicable consumer protection law.
9. CUSTOMER ACCOUNTS
You may be able to create or access a customer account using the sign-in methods made available through Shopify.
You are responsible for keeping your account access secure and for promptly notifying us if you believe your account has been accessed without authorisation.
We may restrict or suspend access where reasonably necessary to protect customers, prevent fraud, comply with law or protect the security of our store. This will not affect rights relating to orders already accepted.
10. ACCEPTABLE USE
You may access and use our website only for lawful purposes.
You must not:
• use the website for an unlawful, fraudulent or malicious purpose;
• infringe the intellectual property, privacy or other legal rights of another person;
• upload or transmit malware, viruses or harmful code;
• interfere with the security or operation of the website;
• attempt to gain unauthorised access to any account, system or data;
• impersonate another person or provide deliberately misleading information;
• send spam or unauthorised promotional material;
• scrape, copy or extract website content through unauthorised automated methods; or
• attempt to bypass security, access restrictions or protective measures.
We may take reasonable technical or legal steps to prevent prohibited use.
11. INTELLECTUAL PROPERTY
Unless otherwise stated, the website and its content—including text, branding, graphics, photographs, layouts and designs—are owned by or licensed to DM AMBALAJ LTD, Shopify or the relevant rights holder.
You may use the website for personal, non-commercial shopping purposes.
You must not reproduce, distribute, sell, commercially exploit or modify protected content without permission from the relevant rights holder, except where permitted by law.
Third-party names, logos and trademarks remain the property of their respective owners.
12. CUSTOMER REVIEWS AND OTHER CONTENT
If you submit a review, photograph, comment or other content, you confirm that you have the right to submit it and that it is accurate, lawful and does not infringe another person’s rights.
You grant us a non-exclusive, royalty-free licence to display and use that content for operating and promoting our store, subject to applicable privacy and consumer law.
We may decline to publish or remove content where reasonably necessary because it is unlawful, abusive, misleading, irrelevant, infringes third-party rights or contains personal or confidential information.
We will not suppress or manipulate genuine reviews merely because they are negative.
13. THIRD-PARTY SERVICES AND LINKS
Our website may contain links to or features provided by third parties.
We are not responsible for the content or operation of independent third-party websites. Accessing an external website is subject to that website’s own terms and privacy practices.
This store is hosted and powered by Shopify. Shopify provides the ecommerce platform that enables us to operate the store, but the contract for products purchased from MukodesignUK is between you and DM AMBALAJ LTD, not Shopify.
Nothing in this section excludes responsibility that cannot lawfully be excluded.
14. PRIVACY
We process personal information in accordance with our Privacy Policy and applicable data protection law.
Shopify and other service providers may process personal information to provide hosting, payments, customer accounts, security, analytics and other ecommerce functions. Further information is provided in our Privacy Policy.
15. OUR RESPONSIBILITY TO YOU
Nothing in these Terms excludes or limits:
• liability for death or personal injury caused by negligence;
• liability for fraud or fraudulent misrepresentation;
• your statutory consumer rights; or
• any other liability that cannot lawfully be excluded or limited.
If we fail to comply with these Terms, we are responsible for loss or damage that is a foreseeable result of our breach or failure to use reasonable care and skill.
Loss or damage is foreseeable if it is obvious that it may happen or if both you and we knew that it might happen when the contract was formed.
We are not responsible for loss caused by your misuse of a product, failure to follow supplied instructions or provision of materially incorrect information.
If you are purchasing as a consumer, we do not accept responsibility for business losses, including loss of profit, revenue, opportunity or business interruption.
16. EVENTS OUTSIDE OUR REASONABLE CONTROL
We are not responsible for delay caused by events outside our reasonable control where we have taken reasonable steps to prevent or minimise the effect of the delay.
If such an event causes a material delay, we will contact you as soon as reasonably possible and take steps to reduce its effect.
Your statutory rights relating to delivery, cancellation and refunds remain unaffected.
17. SUSPENSION OR TERMINATION OF WEBSITE ACCESS
We may suspend or terminate access to the website where reasonably necessary because of unlawful use, fraud, security risks, serious breach of these Terms or legal requirements.
Suspension or termination of website access does not remove any rights or obligations relating to orders already accepted or any statutory rights you have.
18. CHANGES TO THESE TERMS
We may update these Terms to reflect changes to our store, services, technology or legal obligations.
The version applying to an order will normally be the version available when that order was accepted.
Changes will not retrospectively remove or reduce rights relating to an order already accepted unless required by law.
Where reasonably practicable, material changes affecting registered customers will be communicated through the website, customer account or available contact details.
19. TRANSFER OF RIGHTS AND OBLIGATIONS
We may transfer our rights or obligations under these Terms only where this does not reduce your contractual or statutory protections.
If a transfer could materially affect your rights, we will notify you where required by law.
Nothing in this section prevents you from exercising or transferring a right where applicable law permits you to do so.
20. SEVERABILITY AND WAIVER
If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
If we do not immediately enforce a right under these Terms, that does not mean we have waived that right.
Nothing in these Terms excludes any statement or representation that forms part of the contract under applicable consumer law.
21. GOVERNING LAW AND COURTS
These Terms are governed by the law of England and Wales.
If you are a consumer resident in Scotland or Northern Ireland, you also retain the benefit of any mandatory protections available under the law applicable where you live.
You may bring legal proceedings in the courts of the part of the United Kingdom in which you live or in the courts of England and Wales.
